HB1500: concerning resale certificates. Another bill with minor benefit. It outlines what must be in the resale certificate but no penalty to the Board Members if they refuse to follow this law. HRLNG recommends speaking in favor of it so that if Washington State every puts in an effective enforcement, these laws will be in place.
HB1501: establishing the right to a response This is another bill of TINY benefit. It requires the HOA to respond to a homeowner enquiry within 30, but no penalty to the Board Members if they refuse to follow the law. The HOA can also set any restrictions on the amount of inquiries it will answer in any time period. Like one inquiry ever 10 years. What if we get rid of the inquiry limit. Then what happens if an obnoxious homeowner sends in 10 inquiries a day. This is not an area that can be legislated. HRLNG members should try to amend this bill to include Proposed Legislation #2 and our other Proposed Legislations.
SB 5129 5129 is another crazy bill that makes some laws applicable to some HOAs but not others, based on the date that the HOA originated. How does that make sense? It also has a lot of clauses that say that the Declaration overrides the law. How does that make sense? These clauses give the Developer AND the Board the right to decide whether or not to follow the law. HOW DOES THAT MAKE SENSE? Try to amend the bill to include Proposed Legislation #2 and our other Proposed Legislations.

5129-S AMS HARR S1407.1 Creates a task force in the Attorney General's Office to study and make recommendations regarding the impacts of the Washington Uniform Common Interest Ownership Act Chapter 64.90 RCW on new and pre-existing homeowners' associations governed under Chapter 64.38 RCW and recommend remedial steps including amending the Consumer Protection Act to provide relief for homeowners when an association engages in conduct in violation of Chapter 64.38 RCW.
5129-S AMS HARR S1408.1 Creates an office of the homeowners' association ombuds in the Attorney General's Office and requires the ombuds to establish by rule an annual fee to fund the office.

Must develop and publicize procedures intended to result in fair elections
Must provide monitors and vote counting services to HOAs, intended to result in fair elections when 15 percent of the total voting interests of a homeowners' association, or six owners, whichever is greater, petition the ombuds to do so.
Must provide meetings, mediation, or other forms of ADR
May receive complaints regarding potential violations of the law, rules, regulations, or documents governing
Must investigate any complaint received and, if meritorious provide ADR.
May refer meritorious violations of law to the AG attorney general or other appropriate law enforcement agency for 39 prosecution;
May subpoena witnesses, compel their attendance and 1 testimony, administer oaths and affirmations, take evidence, and require by subpoena the production of books, papers, records, or other evidence needed for the exercise of the powers or the performance of the duties vested in the ombuds under this section.

5129-S AMS HARR S1420.1 Homeowners' Associations created before July 1, 2018, are not subject to the provisions of the Washington Uniform Common Interest Ownership Act (WUCIOA), and if there is a conflict between the Homeowners' Association Act and the WUCIOA, the Homeowners Code Rev/AF:jlb 1 S-1420.1/25 Association Act controls. Repeals the January 1, 2028, expiration of the Homeowners' Association Act

The one good thing about this law is that it proved that it is constitutional to write retroactive laws and it created one set of laws no matter what year your HOA was created.
