Romeoville, IL 60446 (815) 372-0085 Email: info@repdagmara.org According to Avelar's office, this bill failed because the AGs Office said it was unconstutional because it took away the homeowners right to sue the HOA. Our Proposed Legislation puts the HOA laws under then Consumer Protection laws, gives the homeowner the option to sue or to allow the State HOA Office to sue on behalf of the homeowner. Unfortunately this part was not put in the bill, and we were not aware of the AGs objection before the bill was voted down. If our Illinois members were more involved, it would be more likely that we would have gotten this bill passed.
