I am YOUR NAME, with HOA Reform Leaders National Group (HRLNG). We are a group that is attempting to fix the HOA laws of all the states to protect the homeowners from corrupt Board Members, corrupt Property Managers and corrupt Attorneys. We are working to bring together all the HOA Reform efforts across the USA. We have members from all 50 states and DC. And our members report very similar problems in every state.
The MAIN problem is there are no penalties in the law for Board Members or Property Managers that violate the State HOA laws or the governing documents of the HOA. There is no government agency that will investigate and prosecute corrupt Board Members or Property Managers of HOAs, even severe CRIMES such as embezzlement or other RICO crimes that DO have penalties in the law, when committed by Board Members or Property Managers of HOAs.
Therefor homeowners have to risk their life savings a potentially their home to pay for attorneys to try to force the HOAs to follow the laws, while the corrupt Board Members and Property Managers use the collective funds of the HOA and the insurance of the HOA to pay for their attorney’s fees.
Should the HOA lose a lawsuit against a homeowner, the amount awarded to the homeowner is paid by the HOA insurance, or the collective funds of the homeowners. Thus under current laws, it is the other innocent homeowners that pay whether they win or lose and the corrupt Board Members and/or Property Managers in violation are at no risk.
Although technically the homeowners could file suit against the HOA to attempt to force them to follow the laws, the average homeowner, and especially low-income homeowners, typically do not have enough money to challenge the HOA in court, therefore in reality, HOAs are virtual dictatorships. And if an investor can purchase more than 50% of the homes in an HOA, he becomes an unstoppable dictator.
So HOAs then in fact are dictatorships allowed by law, right here in the USA, that can be sold to anyone with the money to buy them. We feel this is a significant national issue.
There is a company called Community Associations Institute (CAI). CAI is a large lobbying group that has extreme influence over most of the state legislators. The represent the HOA attorneys and the HOA Property Managers and to some degree the HOA Developers. When we talk to the legislators about creating fair laws for the homeowners, they frequently tell us to talk to CAI, and they generally allow CAI to influence their decisions far more than the homeowners. CAI is headquartered in Dubai.
So putting the picture all together, we have a foreign entity, CAI, instructing the legislators of all the states, and effectively legal bribing them with campaign contributions, on what laws to put into effect in HOAs, to allow these dictatorships to exist in the USA that are for sale to anyone who can purchase more that 50% of the properties. Frequently the corrupt Board Members, Attorneys and Property Managers work together as a team to pull more money from the homeowners.
Miami Dade State Attorney Katherine Rundle talks about this in an interview with CBS about a case she did prosecute. I think she is the only State Attorney in the US that is willing to prosecute HOAs. These are not the only problems. Many ask why we don’t just vote them out? Because of the bad voting laws in most states it is easy for corrupt Board Members to manipulate the elections. There are many, many other problems with the HOA laws.
