Aloha,

I am writing about AOAO/HOA reform.  This is a big issue, not just in the State of Hawaii, but across the country and it is an issue that effects thousands of homeowners in this state and millions around the country. 

HOAs are in effect governments that have been given powers of a municipality by State Governments with none of the oversights of normal government agencies.  As there are no penalties in the laws for Board Members or Property Managers that violate the AOAO laws, and no government body that enforces them, many Board Members and Property Managers see no reasons to follow the laws.   All enforcement of these laws is left to the homeowners, who have to sue the AOAO/HOA in court.  Corrupt Board Members can use the collective funds of the AOAO and the insurance of the AOAO but the homeowner must risk their life savings and possibly lose their home to pay their attorney fees, attempting to force the AOAO to follow the laws.  Very few homeowners can afford this.  Because of this situation, AOAOs/HOAs become virtual dictatorships.

About half of the homes in the United States now fall under some form of HOA.   These homeowners can be accused, convicted and fined for Covenant violations with no due process.   Liens can be put on their homes and the homes can be foreclosed and put up for Sheriff’s sale where the home can be sold for anything more than the debt owned on it.  The homeowner could lose a $400,000 home due to a being falsely accused of violating a covenant.  Most HOA home owners are not aware of the financial danger they are in when purchasing a home in an HOA until it is too late.  

We are working on changing the Hawaii State Laws to give the AOAO homeowners a safer place to live.

We don’t come to you with just problems, we come with solutions.  We have created Proposed Legislation that we believe, if put into law in Hawaii, will solve 95% of the AOAO problems.  We would like to talk to you about these solutions.
